Paving a front garden: planning and drainage checks before the quote

Original planning overview. Use the actual project requirements.

Whether paving a front garden needs planning permission depends on the property, the proposed surface and drainage, and any restrictions affecting the site. Check those points before treating a paving quotation as permission to start.

This guide concerns the planning position in England. For a London property, begin with the relevant local planning authority and your proposal, including vehicle access, changes to levels and any boundary work.

First check which property the rules apply to

The Planning Portal's front-garden guidance describes householder allowances and their exclusions. They do not automatically apply to flats, maisonettes or every converted house. Planning conditions, an Article 4 direction and other restrictions can also affect the position.

Identify the property type and ask the local authority to clarify relevant restrictions. Listed status and other proposed alterations need their own checks, because a general driveway rule does not cover the whole project.

Then check surfacing and rainwater

For houses where the allowance applies, the Planning Portal explains that permeable surfacing, or directing rainwater to a lawn or border to drain naturally, can avoid the need for a front-driveway planning application. An impermeable surface covering more than five square metres without that drainage provision needs permission.

Ask the designer or installer to explain how the proposed construction and drainage meet the intended arrangement. Government guidance on permeable front gardens provides background on the approaches. A surface product name alone does not tell you how the complete paved area is designed.

A decision checklist before requesting prices

CheckInformation to obtain
PropertyHouse, flat or other building; known permissions and relevant restrictions.
Proposed areaMeasured paving extent, intended use and existing construction.
Surface and build-upSelected system and the designer's explanation of its drainage arrangement.
Runoff destinationWhere rainwater is proposed to go and what site assessment is needed.
AccessExisting vehicle crossing and any proposed dropped-kerb or highway work.
Other alterationsWalls, fences, gates, levels and any separately required consent.

Use the answers to decide what needs confirmation before pricing or construction. Give each unresolved question to a named adviser or authority, and do not assume that an attractive design is permission-free.

Keep a dropped kerb separate

The driveway and the vehicle crossing over the pavement are different parts of the proposal. The Planning Portal directs householders to make a dropped-kerb application to the local authority where needed. Check the council's process and any relevant planning requirements for your access.

Include boundary changes in the brief as well. Removing a wall or adding a gate may raise questions the paving rule does not answer.

An example of an incomplete quotation brief

Say a homeowner asks for “new front paving” but has not decided where rainwater will go or whether the vehicle entrance will change. This is a hypothetical example. Two contractors could price different drainage and access assumptions.

Resolve those assumptions, obtain the appropriate advice or permissions and issue the same scope to each contractor. Identify preparation, removal, levels, drainage, surface, edges and reinstatement so the offers cover comparable work.

What to send Vayton

Send photographs, the postcode, a measured sketch, proposed use and any planning or council information for the scheme. We can discuss an external works package against that brief. The responsible planning authority or appointed adviser should confirm the permission position for your property.
